Terms of Service
These Terms govern your use of TaskShot. By accessing or using the service, you agree to these Terms.
Eligibility and Acceptance
You must be legally able to enter into a contract and use the service in compliance with applicable laws.
Account and Security
- Provide accurate account information and keep it up to date.
- Keep credentials confidential and protect access to your account.
- You are responsible for activity under your account unless caused by our breach.
- Notify us promptly if you suspect unauthorized access.
Customer Content Responsibility
You retain ownership of content you submit and are solely responsible for its legality, accuracy, and rights clearance. You grant us a limited license to host, process, and display that content only to provide the service.
Acceptable Use
- Do not use the service for unlawful, fraudulent, or abusive activity.
- Do not upload malware, harmful code, or content that infringes rights.
- Do not attempt unauthorized access, interference, or reverse engineering.
- Do not use the service to send spam or violate third-party terms.
Fees and Billing
Paid plans are billed according to your selected subscription terms. Unless required by law, fees are non-refundable. You are responsible for applicable taxes.
Media storage and fair use
TaskShot includes media storage capacity with paid plans for use in connection with the service. Included storage is a fair-use allowance for normal operational workflows, not unlimited or standalone cloud storage.
- Intended use: photos, videos, and documents uploaded for cases, tasks, teams, field work, audits, and related business workflows that the product is designed for.
- Normal use: storage consumption that is proportionate to your plan, included seats, and active use of the service over time.
- Closed or inactive case media may be moved to colder storage classes (for example Glacier Instant Retrieval) while remaining available through the product according to product rules.
- Storage abuse includes, without limitation: using TaskShot primarily as generic file hosting, a public CDN, a backup/archive service, or bulk distribution unrelated to TaskShot workflows; uploading content you lack rights to use; circumventing limits or technical controls; repeated use materially above included capacity after we have notified you; or activity that materially harms service performance or other customers.
- We may monitor aggregate storage usage and notify organization administrators when usage is high. Exceeding included capacity does not automatically purchase extra storage unless we agree otherwise in writing (for example a plan change, Extra Storage add-on, custom invoice, or separate agreement).
- We do not permanently block uploads solely because included capacity is exceeded. We may, however, restrict new uploads, apply technical limits, require a plan change or additional fees, suspend access, or terminate the account if usage is abusive, creates legal or security risk, remains unresolved after reasonable notice, or agreed fees are not paid.
- Nothing in this section limits our rights under “Suspension and Termination” or “Acceptable Use”.
Intellectual Property
The service, software, and branding are owned by us or our licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive right to use the service.
Suspension and Termination
We may suspend or terminate access if you materially breach these Terms, create security or legal risk, or fail to pay fees. You may stop using the service at any time.
Hosting and service area
Hosted in Central Europe — works worldwide; media may be slower outside the region.
Limitation of Liability
To the maximum extent permitted by law, the service is provided "as is" without warranties, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
Data Processing Agreement (GDPR Article 28)
This section is the data processing agreement between the Customer (your organization, as data controller for customer content) and BuildWise Technologies Kft. (TaskShot, as data processor). By accepting these Terms, you agree to this DPA on behalf of your organization.
- Subject matter and duration: processing personal data as needed to provide and support the TaskShot service for the term of your subscription and any post-termination retention period described in these Terms and our Privacy Policy.
- Nature and purpose: hosting, storing, backing up, transmitting, displaying, and otherwise processing customer content and related account data solely to operate, secure, maintain, and improve the service.
- Types of data and data subjects: identification and contact data of your users; customer content (including photos, videos, documents, case/task/form data, and metadata); usage and technical logs. Data subjects include your employees, contractors, and any individuals whose data you upload or whose data appears in customer content.
- Controller instructions: we process customer content only on your documented instructions, meaning your use of the service and any additional written instructions you give through authorized support channels. We will inform you if we believe an instruction infringes applicable data protection law.
- Confidentiality: persons authorized to process personal data are bound by confidentiality or are under an appropriate statutory duty of confidentiality.
- Security (Article 32): we implement appropriate technical and organizational measures as described in our Security page and Privacy Policy, including access controls, encryption in transit and at rest where appropriate, monitoring, and incident response.
- Sub-processors: you authorize us to engage sub-processors that support the service (including, without limitation, Amazon Web Services for hosting in EU regions and Paddle for payment processing). We contractually bind sub-processors to data protection obligations no less protective than this DPA. We will inform you of intended changes to sub-processors and give you a reasonable opportunity to object on material grounds.
- Assistance: we will assist you, taking into account the nature of processing and information available to us, with data subject requests, security of processing, breach notification to supervisory authorities and data subjects where required, and impact assessments and prior consultation where applicable, in line with Articles 32–36 GDPR.
- Deletion and return: upon termination of the service, we will delete or return customer content and related personal data within a reasonable period, except where retention is required by law or permitted under these Terms (for example backup cycles or dispute resolution). You may export data through product features before termination.
- Demonstration and audits: we make available information reasonably necessary to demonstrate compliance with Article 28 and allow for audits conducted by you or an independent auditor, no more than once per year unless required by a supervisory authority, with reasonable prior notice and subject to confidentiality and security restrictions.
- International transfers: where personal data is transferred outside the European Economic Area, we use appropriate safeguards such as the EU Standard Contractual Clauses or equivalent mechanisms as described in our Privacy Policy.
- Liability: each party's liability under this DPA is subject to the limitation of liability in these Terms. Nothing in this DPA limits either party's liability for breaches of data protection law where such limitation is not permitted.
Public reference logos
We may display your organization name on our public website (and your logo when you upload one) only if your organization owner gives explicit opt-in consent in account settings. Showcase display is limited to an active paid or trial entitlement; when that ends, we remove the name/logo from public showcase within a reasonable period. Consent can be withdrawn at any time; we store a timestamp and audit record when consent changes.
